The new version of House Bill 2904 that deals with threatened hoop house taxation is now posted on the Web (HTML|PDF). It’s a multipurpose bill dealing with exclusive farm use designations and other matters; the pertinent language for hoop house owners specifically is contained way down at the bottom:
A real property building, structure or improvement is
exempt from ad valorem property taxation if it:
(a) Is used primarily to grow plants for agricultural or horticultural production;
(b) Is covered with polyethylene, fiberglass, corrugated polycarbonate acrylic or any other transparent or translucent material designed primarily to allow passage of solar heat and light; and
(c) Does not have a permanent heat source other than radiant heating provided by direct sunlight.
The bill is headed for the floor of the Senate on Wednesday (June 24). It also would require House concurrence and the governor’s signature.
